Terms and Conditions for Yallabid
General: The section defines the terms and conditions for your engagement with Yallabid. These terms and conditions forms a binding agreement that defines the interactions among all parties associated with the website. By accessing this website we assume you accept these terms and conditions. Do not continue to use yallabid.com if you do not agree to take all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of UAE. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Participant Guidelines: Yallabid advises all participants and members to read the regulations governing their client relationships. Continuing to the registration process implies the participants' agreement to all the terms stipulated in the terms and conditions, establishing the nature of the relationship between the parties.
Application and Bidding: Before bidding, all participants must ensure their Yallabid applications are regularly updated to the latest version available on their device's app store. Failure to update the application may result in missing information or service changes, for which Yallabid cannot be held responsible.
Currency and Transactions: All transactions are conducted in UAE Dirhams. Yallabid is not liable for losses due to currency conversion and/ or bank transfers between different currencies.
Fines and Regulations: For each returned check, a fine of 1000 Dirhams is applicable.
Bidding Deposit and Refunds: The Bidding deposit amount is refunded based on our registration data. If the deposit was made through another entity, it will be refunded to the original payment source. Refunds are carried out through bank checks or bank transfers.
Vehicle Registration and Presentation: Items are registered under the bid winner’s name or in the name of person, authorized by the bid winner. Note that Yallabid does not guarantee the registration of classic vehicles. All items are sold in their current condition, as displayed on the website. Yallabid does not guarantee any statements, specifications, information, or details the vehicles suppliers provide. This encompasses but is not restricted to, odometer accuracy, ownership guarantees, information in attached inspection reports, vehicle or equipment condition, manufacturing year, and export eligibility. Bidders are responsible for reviewing the data, advertisements, and information about the item's condition before bidding.
Value-Added Tax and Fees: Value Added Tax (VAT) will be added according to the Federal Tax Authority (FTA) Law No. 2017/8 issued by the government of the United Arab Emirates, amounting to 5% on the final auction price (where applicable), along with all additional fees, including but not limited to administrative fees, late payment fees, late collection fees, storage fees, delivery fees, and export fees.
Pre-Purchase Inspections: All participants must thoroughly inspect the vehicle they intend to purchase and ensure that it matches the provided specifications before placing a bid.
Authorized use of platform: It is the user / bidder responsibility to ensure that his account is used for authorized purposes. Any action taken from his account shall construed to be authorized and legally binding on part of the user
Settlement and Clearance of Payment: The winning bidder of an offered item must pay for the amount due within two working days from the Auction end date else an administrative fee of AED 250 per day shall be charged on account of the bidder.
Bidding deposit Forfeiture: The Bidding deposit will be forfeited if the account holder violates the terms and conditions of the website usage, fails to pay the value of the purchased item/items, or defaults on the payment.
Vehicle Care and Responsibility: Upon receiving the vehicle from Yallabid, the buyer must maintain its condition as received. The buyer must park the car in a designated parking area to prevent its impoundment by the police due to being an unlicensed vehicle with pending legal matters until the transfer of ownership in the name of the bid winner or any nominated person on his behalf.
Vehicle Ownership Limit: Members are allowed to bid for an unlimited number of products / vehicles listed in auctions.
Intellectual Property Rights: All rights to use names, trademarks, service names, asset names, logos, slogans, and images belong solely to the platform owners.
Comprehensive Applicability: The provisions of this document cover all aspects of the registration agreement entered into by the various parties.
User Commitments: By becoming a site member, you agree to adhere to the following guidelines while utilizing the services of Yallabid:
1. Compliance with Terms and Agreements: You commit to refraining from any actions that violate any individual or entity's rights, laws, or agreements.
2. Eligibility and Authority: You confirm that you possess the legal authority to participate in bidding on the site. You must also be at least 18 years of age and not subject to any temporary or permanent bans from using the platform.
3. Payment and Auction Integrity: Upon winning a bid, you are responsible for completing the payment for the purchased vehicles. The user is strictly prohibited, from attempting to bypass the established auction process.
4. Accuracy and Integrity of Information: You must provide accurate and truthful information, avoiding any false or misleading details that could harm or defame any individual or entity.
5. Confidentiality of Username: Your Yallabid username is personal and confidential. Sharing it with any other party requires prior permission from the platform.
6. Responsible Communication: You agree not to transmit disruptive, harmful, or invasive materials to any party using the site. Fabricating messages on behalf of Yallabid is strictly prohibited.
7. By continuing to use the services of Yallabid, you acknowledge your understanding and acceptance of these terms.
Website Management Rights: Yallabid reserves the right to modify, suspend, or terminate any of its services on the site. It also has the right to prevent users from accessing the site, remove any posted content from its site or social handles, or take electronic or legal actions to prevent users from accessing the site without prior notice, should the management of Yallabid find it necessary. The company also reserves the right to deactivate any active accounts.
Service Fees: Yallabid reserves the right to change, amend the fees and charges on the services provided by the platform. the user is expected to review the updated schedule of charges available on the platform before utilizing or enjoying any such services.
Automated Access Restrictions: As a site user, you agree not to use robots, spiders, scrapers, or other automated means to access, copy or scrap any information without prior permission.
Vehicle Document Processing Time: The estimated duration for processing vehicle documents is approximate, and Yallabid holds no liability for any potential delays.
User Conduct: You are required to comply with the following user conduct guidelines while using the website:
- Engage in no activity that may adversely affect the website's infrastructure.
- Refrain from impacting or attempting to impact the website's operation or activities.
- Do not obstruct users' access to the website or limit access for specific groups in any manner.
Complaints: For any feedback or complaints about the service or listed items, promptly contact us at: cs@yallabid.com. We aim to respond within three working days, handling complaints professionally.
Customer Privacy Policy: We treat all your information with confidentiality. We collect data from registered members only. Statistical information about website visitors is gathered randomly to ensure data privacy.
Applicable Law and Jurisdiction: These terms follow the Emirate of Dubai laws and the UAE's federal laws, applicable in Dubai. Disputes relating to these terms fall under Dubai's court jurisdiction.
Yallabid Role: Yallabid is not a party to the seller-buyer contract. It can't be implicated, nor its employees, managers, or partners, in matters regarding items' specifications, ownership, or related issues.
Compensation: A. If claims or lawsuits arise from auctioned items, you agree to keep Yallabid free from responsibility, loss, or damage, whether or not it's involved.
B. You won't claim against Yallabid and will indemnify it from claims, losses, or damages resulting from various situations, including using the electronic auction service, violating terms, infringing third-party rights, or providing inaccurate item information.
Buyer's Acknowledgment: The buyer comprehensively examines items before purchase, following religious and legal standards. Items are sold as-is, without any related warranty or confirmation, from Yallabid. The buyer can't return items due to defects. Yallabid facilitates the selling process and does not possess prior familiarity with the items. Buyers inspect items, verify displayed data, and assess accuracy before bidding.
Cookies: We employ the use of cookies. By accessing yallabid.com, you agreed to use cookies in agreement with the Yallabid&aposs Privacy Policy. Most interactive websites use cookies to let us retrieve the user’s details for each visit.
